Your use of our Site for the limited and exclusive purpose of reviewing this Policy does not constitute your agreement to this Policy unless you make further use of our Site. Our clients include closely held businesses, professional practices, entrepreneurs and startup founders, rental and commercial property owners, and individual investors and business owners. This Policy applies to information collected through our Site, through our marketing and communication channels, and in connection with our Services, except where a separate written engagement agreement, confidentiality agreement, or non-disclosure agreement governs, in which case that agreement controls with respect to the information covered by it.

2. Age Restriction

Our Site and Services are intended solely for individuals who are at least eighteen (18) years of age. If you are under eighteen (18), please do not use our Site, submit any information to us, or subscribe to any of our communications. If we become aware that we have collected personal information from an individual under the age of eighteen (18), we will take reasonable steps to delete that information promptly.

3.2 Information Collected in Connection with Our Services

Because of the nature of our Services, clients and prospective clients may provide, and we may collect, receive, access, or process, sensitive business and financial information, including:

• Financial statements, general ledgers, trial balances, and accounting records
• Bank, credit card, loan, and merchant account statements and related banking information
• Business and individual tax returns and supporting schedules
• Payroll registers, compensation data, and related payroll information
• Employee and contractor information provided to us by our clients
• Employer Identification Numbers and other business tax and entity identifiers
• Credit card and payment information
• Driver’s licenses and other government-issued identification provided in connection with engagements, entity formation, lending, or transaction diligence
• Property records, appraisals, construction and renovation documentation, closing statements, and depreciation schedules
• Contracts, corporate records, diligence materials, valuation inputs, customer and vendor data, and other confidential business records

We do not require or request Social Security Numbers through our Site. Where an engagement requires information of that nature, it should be transmitted only through a secure channel designated by us and never through a website form or ordinary email.

4. How We Collect Information

We and our third-party service providers may collect information in the following ways:

• When you complete a contact form, request information, request a consultation, subscribe to our newsletter or other communications, or opt in to text messaging on our Site.
• When you access or use our client portal.
• When you contact us by telephone, email, text message, video conference, or messaging application, or through our social media pages.

5. Cookies, Tracking, and Visitor Identification Technologies

Our Site uses cookies, tracking pixels, tags, and similar technologies. A cookie is a small amount of data sent to your browser from a web server and stored on your device. A tracking pixel is a graphic that loads when a user visits a web page or opens an email and is used to record certain user activity.

5.1 Visitor Identification and Lead Intelligence

You should be aware that our Site uses visitor identification technology. This technology attempts to resolve otherwise anonymous website traffic into identifiable businesses and, in some cases, individual contact information, by matching online identifiers such as IP addresses, device identifiers, cookie identifiers, and hashed identifiers against third-party databases maintained by our providers. This means that we may learn that you or your organization visited our Site, which pages you viewed, and how to contact you, even if you did not complete a form.

Information obtained through these technologies may be used to identify prospective clients, to follow up regarding your apparent interest in our Services, to tailor marketing and advertising, and to measure the effectiveness of our marketing. Depending on your state of residence, this activity may constitute “sharing” or “targeted advertising” under applicable law, and you may have the right to opt out. See Section 11 for your rights and Section 13 for how to submit a request.

5.2 Managing Cookies and Advertising Preferences

• You may manage your cookie preferences through the cookie consent banner presented on our Site, where available.
• You may configure your browser to refuse or delete cookies, though some portions of our Site may not function properly as a result.
• You may opt out of certain interest-based advertising by visiting the Digital Advertising Alliance at http://www.aboutads.info/ or the Network Advertising Initiative at http://networkadvertising.org/.
• You may review and adjust advertising settings directly with platforms such as Google, Meta, LinkedIn, and Microsoft.
• You may contact us at info@thebizoptimizers.com to request that we cease using your information for targeted advertising purposes.

5.3 Do Not Track

Our Site does not currently respond to “Do Not Track” browser signals because no uniform industry standard has been adopted. Where required by applicable law, we will honor recognized universal opt-out mechanisms, such as Global Privacy Control signals, to the extent we are able to detect and process them.

We and our third-party service providers may use the information we collect to:

7. Communications, Recording, and Transcription

By engaging with us, you acknowledge and agree that, where permitted by applicable law, we may:

• Record telephone calls, video conferences, and virtual meetings.
• Generate transcripts, meeting notes, summaries, and action item lists.
• Use automated and artificial intelligence-assisted note-taking, transcription, and summarization tools.
• Store, index, search, and analyze emails, text messages, meeting content, and other communications.
• Use such materials for service delivery, documentation, internal quality control, training, supervision, compliance, security, and recordkeeping purposes.

Where applicable law requires the consent of all parties to a recording, we will provide notice and obtain consent before recording. If you do not wish to be recorded, please notify us at the outset of the call or meeting.

8. Artificial Intelligence and Human Review

We use technology, including artificial intelligence and machine learning tools, to support our business operations and the delivery of our Services. These tools may assist with research, data extraction and organization, analysis, modeling, drafting, transcription, summarization, workflow automation, and business intelligence.

All client-facing analyses, reports, models, valuations, studies, recommendations, and other deliverables are extensively reviewed by qualified human professionals before they are delivered. We do not rely on automated processing alone to produce professional work product, and we do not engage in automated decision-making that produces legal or similarly significant effects concerning you.

We handle confidential information processed through these tools in accordance with our security practices and our contractual obligations, including any applicable confidentiality or non-disclosure agreements.

9. How We Disclose the Information Collected

We do not sell personal information, and we do not disclose personal information to third parties for monetary consideration.

We may share information under the following circumstances:

• Independent contractors and consultants. We may share information with independent contractors, consultants, and professionals who assist us in performing our Services. These parties are engaged under obligations of confidentiality and are permitted to use the information only for the purposes for which it was disclosed.
• Technology and service providers. We may share information with the providers that host, operate, and support our business systems, including Microsoft 365, SharePoint, OneDrive, Microsoft Teams, QuickBooks Online, QuickBooks Payments, and Monday.com, as well as website hosting, email delivery, analytics, advertising, communications, and security providers.
• At your direction. We may share information with attorneys, certified public accountants, lenders, insurers, brokers, buyers, sellers, investors, counterparties, or other advisors when you instruct or authorize us to do so, including in connection with transactions, financings, and diligence processes.
• Marketing and advertising partners. We may share technical data about your browsing activity and device, and contact information in hashed or otherwise de-identified form, with advertising and analytics providers such as Google, Meta, LinkedIn, and Microsoft for purposes of measurement, audience matching, identifying potential clients, and improving our marketing. Residents of certain states have the right to opt out of such sharing. See Sections 11 and 13.
• Legal and protective disclosures. We may disclose information in response to subpoenas, court orders, or other legal process; when required to comply with applicable law; to combat fraudulent or criminal activity; to enforce our agreements, policies, and terms of use; and to protect the rights, property, and safety of our business, our personnel, our clients, and others.
• Business transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, including during diligence, subject to appropriate confidentiality protections.

10. De-Identified and Aggregated Information

We may create de-identified and aggregated data from information we collect and may use and disclose that data for benchmarking, industry and market trend analysis, internal business intelligence, key performance indicator development, marketing statistics, case studies, research, thought leadership, and service improvement.

We will not identify any individual client in connection with such uses without that client’s express written consent. Any information used for these purposes will be anonymized, aggregated, or otherwise presented so that it does not reasonably identify an individual or a specific client, and we will maintain such data in de-identified form and will not attempt to re-identify it except as permitted by law.

11. Consent to Communications, Email, and SMS Text Messaging

11.1 Consent

By submitting a contact form, requesting or scheduling a consultation, requesting information, downloading materials, subscribing to our communications, opting in to text messaging, or otherwise providing your contact information to us, you consent to receive communications from us, including:

• Emails
• Telephone calls
• SMS and MMS text messages
• Prerecorded and automated communications, where permitted by applicable law
• Marketing, promotional, and educational communications
• Service, transactional, scheduling, and account-related communications

Where applicable law requires express written consent for particular marketing communications, we will obtain that consent through a separate, clearly disclosed opt-in. Consent to receive marketing communications is not a condition of purchasing any goods or services.

11.2 SMS Text Messaging Program

If you opt in to our text messaging program, we may collect your name, mobile number, and related information, and we may send appointment reminders, scheduling messages, client and service communications, responses and follow-up regarding inquiries submitted through our Site, and marketing messages. We send text messages using platforms and carriers that may include Microsoft Teams, Twilio, and mobile devices used by our personnel. Message frequency varies. Message and data rates may apply.

We share your information with our messaging providers only as necessary to deliver the messaging service and to comply with 10-Digit Long Code (10DLC) and carrier requirements. Our messaging providers will not sell or share mobile opt-in information or consent for marketing purposes.

11.3 Opting Out

• To stop text messages, reply STOP to any message at any time. Reply HELP for assistance.
• To stop marketing emails, use the unsubscribe link contained in any marketing email.
• To stop marketing telephone calls, tell us during any call or contact us using the information in Section 13.
• To opt out of all marketing communications, email us at info@thebizoptimizers.com.

Even after you opt out of marketing communications, we may continue to send you non-marketing communications relating to an active engagement, your account, or legal and administrative matters.

12. Your Privacy Rights

Depending on your state of residence, including California, Florida, Virginia, Colorado, Connecticut, and other states with applicable consumer privacy laws, you may have some or all of the following rights:

• Right to know and access. To request confirmation of whether we process your personal information and to obtain a copy of, or details regarding, the categories and specific pieces of personal information we have collected, the sources of that information, the purposes for collecting it, and the categories of third parties to whom it has been disclosed.
• Right to correct. To request correction of inaccurate personal information we maintain about you.
• Right to delete. To request deletion of personal information we have collected from you, subject to legal, contractual, professional, tax, and recordkeeping exceptions.
• Right to data portability. To request a copy of your personal information in a portable, readily usable format, where technically feasible.
• Right to opt out. To opt out of the sale of personal information, the sharing of personal information for cross-context behavioral advertising, targeted advertising, and certain profiling. We do not sell personal information.
• Right to limit use of sensitive personal information. To limit the use and disclosure of sensitive personal information to purposes permitted by law.
• Right to non-discrimination. To exercise your privacy rights without receiving discriminatory treatment.
• Right to appeal. To appeal a denial of a privacy request, where provided by applicable law. If your appeal is denied, you may contact your state attorney general.

You may exercise these rights by contacting us as described in Section 13. We will verify your request using the information we maintain about you and may request additional information reasonably necessary to confirm your identity. An authorized agent may submit a request on your behalf with proof of authorization. We will respond within the time period required by applicable law.

Please note that much of the information we process in the course of our Services is provided to us by our business clients, who determine the purposes and means of processing. If you believe we process your information on behalf of one of our clients, please direct your request to that client, and we will assist them in responding as required.

14. Data Retention

We retain personal information for as long as reasonably necessary to provide our Services, maintain business and engagement records, operate our business, comply with legal, tax, accounting, contractual, and regulatory obligations, resolve disputes, enforce our agreements, and establish, exercise, or defend legal claims. When information is no longer required for these purposes, we take reasonable steps to delete it, destroy it, or maintain it in de-identified form.

Retention periods vary based on the type of information, the nature of the engagement, and applicable legal and professional requirements, and may extend well beyond the conclusion of an engagement.

15. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, and destruction. These measures include the use of reputable enterprise cloud platforms, access controls and permissioning, encryption of data in transit and at rest as supported by our platforms, multifactor authentication on company systems, endpoint protection, and confidentiality obligations imposed on personnel and contractors.

No method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your information, we cannot guarantee its absolute security, and any transmission of information to us is at your own risk.

15.1 Your Responsibility for Sensitive Information

You are responsible for the information you choose to transmit to us and the channel you use to transmit it. Please do not submit passwords, account credentials, security questions and answers, PINs, multifactor authentication codes, full account numbers, Social Security Numbers, or other highly sensitive information through our website forms, ordinary email, text message, social media, or any other unsecured channel. If an engagement requires information of that nature, we will provide a secure transmission method. We cannot guarantee the security of information transmitted to us through unsecured channels and disclaim responsibility for information submitted in that manner.

15.2 Breach Notification

In the event of a security incident affecting personal information, we will investigate, take reasonable remedial measures, and provide notification to affected individuals, our clients, and regulators as and when required by applicable law.

16. No Professional or Client Relationship Created

• Business Optimization Group, LLC is not a law firm and does not provide legal advice or legal services.
• No attorney-client relationship is created by your use of our Site, by your submission of information to us, or by any communication with us.
• No client, consulting, advisory, accounting, or other professional relationship is created by your use of our Site, your submission of information, or preliminary communications with us.
• A professional relationship is established only upon execution of a written engagement agreement signed by Business Optimization Group, LLC and the client. No work will be performed and no professional obligations arise prior to that time.
• Information submitted through our Site or in preliminary communications is not automatically privileged or confidential and may not be protected by any evidentiary privilege.
• Please do not send confidential, proprietary, or sensitive information to us until a written engagement agreement has been executed or we have expressly instructed you to do so.
• Business Optimization Group, LLC is not a certified public accounting firm and does not provide audit, review, attest, or other services requiring licensure as a public accounting firm unless expressly stated in a separate written engagement agreement.

17. Professional Services Disclaimer

Content available on our Site, including articles, guides, templates, calculators, benchmarks, and other materials, is provided for general informational purposes only and does not constitute legal, tax, accounting, investment, or other professional advice. It is not a substitute for advice from a qualified professional who has reviewed your specific facts and circumstances. This Policy does not apply to those third parties, and we are not responsible for their privacy practices or content. 19. Visitors Located Outside the United States

Our Site and Services are directed to individuals and businesses located in the United States. Our operations, systems, and service providers are located primarily in the United States, and any information you provide will be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your jurisdiction. If you access our Site or provide information to us from outside the United States, you consent to that transfer and processing.

20. California Notice of Collection

In the preceding twelve (12) months, we have collected the categories of personal information described in Section 3, including identifiers, commercial information, Internet and other electronic network activity information, geolocation data, professional and employment-related information, financial information, government identification documents where provided in connection with an engagement, audio and visual information from recorded meetings and calls, and inferences drawn from the foregoing. We collect this information for the business and commercial purposes described in Section 6, from the sources described in Section 4, and disclose it to the categories of recipients described in Section 9. We do not sell personal information. We may share personal information for cross-context behavioral advertising as described in Section 5, and you may opt out as described in Sections 5.2 and 13. We retain personal information as described in Section 14.

21. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, our Services, or applicable law. The “Last Updated” date at the top of this Policy indicates when it was last revised.
